Terms & Conditions April 2007- March 2008

Contract/Agreement: The contract is between ACR TRAVEL  - either operator or agent - and
any person (client) travelling or intending to travel on an itinerary or tour supplied. This agreement shall be interpreted in accordance with the law of the Northern Territory in the Commonwealth of Australia. The actions, claims, demands or suits arising out of this agreement shall be exclusively justiciable in the courts of the said territory. ACR TRAVEL  has the sole authority to vary or omit any of these terms.

Quotations: All quotations are subject to availability of services quoted and are not guaranteed until the deposit is received and booking confirmed. Some quotations will have validity dates on them and if a deposit is not received by that expiry date then the quotation will automatically cancel without notification to you.  Please note that vehicle rates are subject to change.

Bookings: To secure a booking, ACR requires a completed Booking Form ,
e-mail,  or fax sent by the client  and payment details (credit card number, expiry date, name on card). A booking is valid from the date ACR  confirms acceptance in writing. ACR TRAVEL reserves the right to decline any booking at their discretion. ACR TRAVEL   accepts American Express, MasterCard and Visa (A surcharge of 2% applies for all payments by Visa/MasterCard and 4% applies for all payments by American Express).

Deposits: A deposit will be required to confirm any booking. Deposit conditions for certain products may vary and we will advise you in writing of these conditions at the time of quotation.  Deposits are payable via credit cards.

Deposits are also payable via bank transfer, this needs to be arranged with ACR at time of a booking.  If you are paying via bank transfer payment is to be paid within 24hours of a booking.  Should payments not be in processed into our account within 72hours then the booking will be cancelled (unless prior arrangements have been made with ACR)

Please note that deposits are non refundable.

Exchange Rate / Currency Variations:  All credit card transactions are conducted in Australian dollars. Due to exchange rate fluctuations there could be some variance in the amount refunded compared to the amount initially charged. We do not accept any liability for variances up or down. Refunds by credit card can take up to 15 working days depending on the renter's Financial Institution.

Final Payment: Final payment is normally made on the date of travel at time of pickup of your rental.  Final payment conditions for certain products may vary and we will advise you in writing of these conditions at the time of quotation. In the case of non-payment of the balance by the due date, ACR TRAVEL  will treat the booking as cancelled unless the client communicates to the contrary. Some operators will request the balance of payment prior to travel. If this is the case, ACR TRAVEL  will advise you as soon as this is known.

Prices: All prices will be quoted in Australian Dollars for Australian services,  NZ Dollars for NZ services and  SA RAND for Southern Africa services.  Please use a currency converter to check the cost. All prices include Australia Goods and Services Tax of 10% and New Zealand Goods and Services Tax of 12.5%.

Cancellations: Must be in writing and can either be per email, facsimile, or by letter.  No cancellation will be accepted unless received in writing and received by us directly from you. The date that we receive the cancellation notice is the date that it is deemed cancelled.

Please note that should you need to cancel your booking this NEEDS to be done no later then 30 days prior to your pick up date. There is a $150 Admin fee  to cancelled bookings.

Cancellation Policy: ACR TRAVEL  will charge a minimum cancellation fee (Admin Fee) of AUD$150.00 to cover banking and administration costs. Cancellation conditions for certain products may vary.  Deposits are non-refundable. Passengers should confirm prior to booking if they have any questions.  Refunds will not be made for bookings cancelled due to inclement weather. Suppliers may impose their  own cancellation conditions as well. We strongly recommend that you take out travel insurance, including cancellation insurance!

Cancellation Fees
If cancelled 30 days prior to pick up - Admin fee $150
If cancelled 7 to 29 days prior to pick up - 20% of Gross Rental (minimum $200)
If cancelled less than 7 days prior to pick up - 80% of Gross Rental
If cancelled on the day of pick up or no show - 100% of Gross Rental
There is no refund for late pick up or early return of vehicle.
 
Please note that these fees are subject to change due to suppliers terms and conditions. 

Ask our staff to advise you of your booked vehicles terms and conditions
(there is also the link on your quotation for a particular vehicle).  Your travel Voucher will also show cancellation fees etc.

Transfer
Vehicles must be collected and returned to our branches (not airports). Transfers to and from the depot are not included in the rental price. It is the renter's responsibility to get to and from the branch.

Driver's Licence and Minimum Age
A valid, non-provisional, state or overseas driver's licence is required. If the driver's licence is not in the English language (eg German, French, Chinese etc) then an international driver's licence is also required. The driver's licence must have been held for at least two years and be valid for the whole length of the rental. The original driver's licence must be shown at time of pick-up when the driver is present.

The minimum age to drive the vehicle is 21 years and the maximum age is 75 years. Excluding the Hippie Camper where drivers minimum age is 18yrs.

Problems: In the event that a client has a complaint about any of the travel arrangements, they must advise the relevant supplier at the time and inform ACR TRAVEL  in writing. This will assist settlement of any grievance or complaint. Any disputes over the quality, fitness and condition of the product is between the client and the product supplier and as such, ACR TRAVEL  cannot be held liable for any problem with the product supplied.

ACR TRAVEL  accepts no liability for personal injuries and losses.

It is the client's responsibility to choose a trip within their capabilities, or a vehicle within their legal capabilities (seat capacity or age limits for example).

Other Conditions: ACR TRAVEL  as operator or agent finalises all arrangements for these products on the express condition that it shall not be held liable for any injury, loss, accident, delay or irregularity which may be occasioned either by reason of any defect in any vehicle, vessel or equipment or by Acts of God or through the acts of default of any company or person engaged in conveying the passengers or in carrying out our arrangements of the tours or otherwise in connection herewith.

ACR TRAVEL  reserves the right to change any of the facilities, services or prices described in the information provided.

ACR TRAVEL  accepts no liability for any action or activity undertaken by the client arranged independently or ACR TRAVEL  while on holiday. ACR TRAVEL  shall not be liable to compensate clients for associated expenses incurred as a result of their booking. No refund will  be made for any unused services that are included in the price.

Please note that the car, campervan and motorhome rental companies reserve the right at their sole discretion to restrict vehicle movements in certain areas due to adverse road or weather conditions.
